PUBLIC EDUCATIONAL SAMPLE Pesticide Certificate of Qualification: Request for Reconsideration Prepared as a public resource by VG Immigration Services Inc. Version: October 2026 This is a generic template, not an actual client letter. It contains no client information, actual application identifiers or signed representative authorization. It does not establish that your credential qualifies or guarantee reopening. Complete every placeholder. Delete any statement that does not match your evidence. The Nova Scotia passages must be replaced with the correct law and facts for a different province; do not use them to describe an Ontario or Alberta credential. Obtain professional review before filing. Do not wait for a response to this request or an ATIP request before protecting any judicial-review deadline. Section 72 of IRPA generally requires service and filing within 15 days for a matter arising in Canada or 60 days for one arising outside Canada. A lawyer should determine your deadline. My request concerns the removal of Certificate of Qualification points from my Comprehensive Ranking System score and the resulting conclusion under section 11.2 of the Immigration and Refugee Protection Act. The decision states: "[INSERT A SHORT, ACCURATE QUOTATION OF THE RELEVANT REFUSAL REASON]." I request reopening because [IDENTIFY THE SPECIFIC LEGAL, FACTUAL OR CALCULATION ERROR SUPPORTED BY YOUR RECORD]. I do not submit that the title "Certificate of Qualification" automatically makes a document eligible, or that an eligible occupation alone establishes entitlement. I ask for assessment of my particular credential's statutory issuer, prescribed qualification process, final status and occupational scope under the applicable federal requirements. RECONSIDERATION AND THE APPLICABLE REQUIREMENT IRCC's operational guidance recognizes discretion to reconsider a refusal, while making clear that reopening is not automatic. I request exercise of that discretion because the issue identified here was material to the removal of points and the refusal. IRCC policy: https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/service-delivery/reconsideration-after-refusal.html Paragraph 26(2)(a) of the Express Entry Ministerial Instructions requires a valid certificate of qualification in a trade occupation issued by a competent provincial or federal authority. I request assessment under the instructions applicable to my invitation round and verification of my qualifications at the relevant invitation and application dates. Ministerial Instructions: https://www.canada.ca/en/immigration-refugees-citizenship/corporate/mandate/policies-operational-instructions-agreements/ministerial-instructions/express-entry-application-management-system/current.html IRCC assessment guidance: https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/permanent-residence/express-entry/assessing-electronic-application-on-section-a11-2.html MY CREDENTIAL AND SUPPORTING RECORD My credential is [EXACT TITLE], class [CLASS], issued by [LEGAL ISSUER] on [ORIGINAL ISSUE DATE], with validity until [EXPIRY]. Its authorized activities and restrictions are [ACCURATE SCOPE]. The evidence of its validity at both relevant dates is [IDENTIFY EVIDENCE]. I completed [ACTUAL EXAMINATIONS AND OTHER REQUIREMENTS], as supported by [DOCUMENTS]. The evidence that this is a final qualification rather than a course-completion or preliminary document is [IDENTIFY EVIDENCE]. It relates to [NOC AND OCCUPATIONAL ACTIVITIES], for the following specific reasons: [EXPLAIN THE CONNECTION WITHOUT INVENTING DUTIES OR WORK EXPERIENCE]. The original application included [LIST MATERIAL ORIGINALLY PROVIDED AND WHERE IT APPEARED]. I now provide [LIST ANY NEW CLARIFICATION, OR STATE THAT NONE IS PROVIDED]. I distinguish this additional material from the original record and do not suggest that the Officer previously received a document that was not submitted. [NOVA SCOTIA ONLY: KEEP THE FOLLOWING PASSAGES ONLY AFTER CONFIRMING THE ACTUAL CERTIFICATE CLASS AND APPLICABLE LAW.] The Nova Scotia Pesticide Regulations authorize the Minister or Administrator to issue specified certificate classes under section 7. Subsection 8(2) prescribes an examination with a minimum mark of 75% before issuance. I request consideration of how those qualification requirements apply to my actual certificate class and authorized occupational activities. Nova Scotia regulations: https://novascotia.ca/just/regulations/regs/ENVPEST.HTM Provincial certification guidance: https://novascotia.ca/nse/pests/applicatorcert.asp Nova Scotia's official explanation states that certificates of qualification demonstrate that an individual conducting a specific activity is qualified to do so, expressly including certificates to apply pesticides. While that explanation does not determine federal CRS eligibility, it is directly relevant to whether my credential has a substantive qualification function. Provincial explanation: https://novascotia.ca/nse/resources/environment.act.compliance.asp AUTHORIZATION AND QUALIFICATION [KEEP AND ADAPT THIS SECTION ONLY IF THE REFUSAL DISTINGUISHES REGULATORY AUTHORIZATION FROM TRADE QUALIFICATION.] IRCC's published guidance requires separate consideration of the competent authority and the credential. Its second step asks whether the document normally demonstrates that the applicant has passed all requirements to be qualified in the particular trade or specified responsible-operator role; its acceptable examples include certain licences outside a traditional apprenticeship framework. IRCC two-step guidance: https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/permanent-residence/express-entry/assessing-electronic-application-on-section-a11-2.html Respectfully, a document may authorize regulated work because the holder has satisfied prescribed qualification requirements. I therefore ask why the actual qualification process and final status established by my evidence are insufficient, rather than treating the authorization function as necessarily excluding qualification. If a further requirement of comparability to another trade certification framework is applied, I request identification of the applicable legal standard and explanation of the requirement my credential fails. I recognize that section 26 requires a qualification in a trade occupation, but ask that this requirement be assessed through the governing framework and the actual evidence. [OPTIONAL LEGAL ANALOGY: RETAIN ONLY IF THE RECORD SUPPORTS AN ADDED ELIGIBILITY STANDARD.] In Xing v Canada (Citizenship and Immigration), 2026 FC 75 at paragraph 16, Justice Azmudeh stated: "The Officer cannot create a moving goalpost and apply a higher standard than the program's." That case concerned an intra-company-transfer work permit, not pesticide certification. I rely on the reasoning only by analogy to the following additional criterion in my decision: [IDENTIFY THE CRITERION AND EXPLAIN WHY IT EXCEEDS THE APPLICABLE REQUIREMENTS]. I do not suggest that Xing establishes acceptance of my credential. Official judgment: https://decisions.fct-cf.gc.ca/fc-cf/decisions/en/529731/1/document.do OCCUPATION AND SCORE IRCC lists NOC 73202 as potentially eligible for CoQ points but warns that occupation-list inclusion does not automatically establish credential eligibility. I request assessment of the occupational connection together with the issuer, certificate class and qualification requirements. IRCC occupation guidance: https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/permanent-residence/express-entry/assessing-electronic-application-on-section-a11-2.html Official NOC: https://noc.esdc.gc.ca/Structure/NOCProfile?GocTemplateCulture=en-CA&code=73202&version=2021.0 My verified CRS was [SCORE] at invitation and [SCORE] at application. The relevant round threshold was [THRESHOLD]. My language results were [RESULTS AND VALIDITY]. The enclosed calculation shows [EXPLAIN VERIFIED EFFECT OF THE CoQ COMPONENT, INCLUDING APPLICABLE CAPS]. I do not assert a calculation error unless the records establish one. REQUESTED OUTCOME I respectfully request reopening and reassessment of my credential under section 26 and the Department's published framework. If the requirements were met at the relevant times, I request restoration of the applicable points, correct recalculation of my CRS and resumption of processing if the remaining statutory, program and admissibility requirements are satisfied. If a specific evidentiary concern remains, I request identification of it and an opportunity to provide focused clarification where appropriate. Where useful, I invite consideration of consultation with Immigration Program Guidance, as contemplated by the published instructions, without asserting that such consultation is mandatory in every case. If reconsideration is declined, I request written confirmation of the outcome and its basis. Thank you for reviewing this request and the supporting documents.
