Two Paths to a Spousal Open Work Permit

There are two distinct eligibility pathways for the SOWP, governed by different IRCC exemption codes:

  • A74 — Spousal sponsorship (inland): The sponsored spouse/common-law partner is physically in Canada with valid immigration status, and the Canadian sponsor has received an AOR for an inland spousal sponsorship application. The sponsored person applies for an SOWP under exemption code A74. This is the most common SOWP pathway.
  • Skilled worker or student spousal OWP: Spouses and common-law partners of certain skilled foreign workers (in NOC TEER 0 or 1 occupations, and some TEER 2/3 occupations) or of international students at eligible DLIs may qualify for an open work permit. The primary permit holder must have a valid work or study permit and must be working or studying in Canada.

The two pathways have different eligibility conditions, supporting documents, and processing considerations. Mixing up the two — or applying under the wrong code — is a common reason for refusals or unnecessary delays.

Eligibility Conditions for the A74 Pathway

For a sponsored spouse applying under the A74 pathway, all of the following conditions must be met at the time of application:

  • The Canadian sponsor has submitted an inland spousal/common-law partner sponsorship application and received an AOR from IRCC
  • The sponsored person is physically in Canada
  • The sponsored person holds valid temporary resident status (study permit, work permit, or visitor record) or has applied to extend status before it expired (implied status)
  • The marriage or common-law partnership is genuine and legally recognised

Applicants who are outside Canada at the time of application, or whose status in Canada has lapsed without an in-time extension, will generally not qualify under A74. Outland sponsorship applicants (where the sponsored person is outside Canada) follow a different process and typically receive a permanent residence visa directly rather than an interim SOWP.

The sponsored person’s existing status in Canada is a critical factor. Visitors with only a visitor record may apply, but officers assess whether the individual has genuinely maintained legal temporary resident status throughout their time in Canada.

Application Process

Applying for a Spousal Open Work Permit requires coordinating timing with the sponsorship application. Here is the typical sequence:

  1. Canadian sponsor submits the inland spousal sponsorship application (including all forms and fees) and receives the AOR. The AOR letter is the key trigger document for the SOWP.
  2. Sponsored person gathers documents for the SOWP application: AOR letter, proof of marriage or common-law relationship (same documents as the PR application), current status document in Canada, valid passport, and biometrics (if not current).
  3. Sponsored person applies online to IRCC for the SOWP. Pay the $155 work permit fee plus the $100 open work permit holder fee ($255 total) plus $85 biometrics if applicable.
  4. IRCC processes the SOWP application — typically 3–4 months. The sponsored person may remain in Canada with implied status (if their existing permit is expiring) while the SOWP is processed.

Duration and Renewability

A Spousal Open Work Permit is typically issued for one to two years and is linked to the ongoing spousal sponsorship (or qualifying temporary status of the principal applicant, for the skilled-worker pathway). It is renewable as long as the underlying qualifying condition — the pending PR application or the principal applicant’s valid status — continues to exist.

When renewing an SOWP, the same conditions must still be met. If the PR sponsorship has been refused, the SOWP cannot be renewed on that basis. If the principal applicant’s work or study permit has been cancelled or expired without renewal, the dependent spouse’s SOWP eligibility under the skilled-worker pathway also ends.

Holders should plan to renew 3–4 months before expiry, particularly given current processing times. Submitting the renewal before the existing SOWP expires maintains implied status and allows continued work authorization during the renewal processing.

Work Rights Under the SOWP

As an open work permit, the SOWP does not restrict the holder to a specific employer, occupation, or location. Holders can work full-time or part-time, change jobs freely, work across provincial borders, and work in virtually any field. The only restriction is that SOWP holders — like all open work permit holders — cannot work for employers on IRCC’s list of ineligible employers. This list includes employers who have been found non-compliant with the Temporary Foreign Worker Program or Immigration and Refugee Protection Act requirements.

Holders of the SOWP are also entitled to access certain federal and provincial employment benefits, including Employment Insurance (EI), on the same basis as other workers with a valid work permit.

Special Considerations for International Student Spouses

Spouses of international students at eligible DLIs may qualify for an SOWP if the student is enrolled full-time in a designated programme. Not all study programmes qualify — IRCC has periodically adjusted these rules. As of recent policy changes, spouses of students in graduate-level programmes (master’s, PhD) and professional degree programmes generally qualify; spouses of students in most undergraduate and college programmes may not.
