Eligibility and Implied Status Explained

To apply for a visitor record extension from within Canada, you must be in Canada as a temporary resident (on a visitor visa, eTA, or as a U.S. citizen), and your current authorised stay must not have expired at the time of application. Application Process and Required Documents

The visitor record extension application is submitted online through an IRCC secure account:

  1. Determine your current authorised stay expiry date — this is on the entry stamp or visitor record in your passport, not your visa expiry date.

  3. Create or log into your IRCC secure account and complete the Application to Change Conditions, Extend My Stay or Remain in Canada as a Visitor (IMM 5708).
  4. Pay the $100 CAD government fee online by credit or debit card.
  5. Submit your application and retain the submission confirmation as proof of implied status.
  6. Do not leave Canada while your application is pending unless you understand that leaving cancels your implied status.

Required documents typically include: copy of your passport (biographical page and any Canadian entry stamps or visitor records); proof of sufficient funds (bank statements or financial support letters); a written explanation of why you need to extend your stay; proof of your plan to leave Canada (return travel itinerary, employment obligations back home, family responsibilities); and any prior IRCC correspondence.

Restoration of Status

If your visitor status has already expired, you may be eligible to apply for restoration within 90 days of the expiry date. Restoration is not guaranteed — an IRCC officer will assess whether your overstay was inadvertent or excusable and whether you remain admissible. The application fee for restoration is $246.25, plus the $100 extension fee if you also want to extend your stay.

Restoration applications take the same lengthy processing time as extension applications and are submitted through the same IRCC portal. If restoration is refused, you must leave Canada. A refused restoration with an ongoing overstay can result in a finding of misrepresentation or a removal order, which would significantly affect future immigration applications.
