H&C Applications in Canada: IRCC’s November 2026 Intake Guidance Explained

November 3, 2026 | VG Immigration Services Inc.
IRCC’s updated humanitarian and compassionate (H&C) intake guidance highlights an important first question: can your request be examined at all? A compelling personal history does not remove every statutory restriction. The intake page is dated November 3, 2026; that update should not be read as the creation of a new permanent residence program. (IRCC intake guidance)

H&C consideration is an exceptional, discretionary route for people whose circumstances may justify permanent residence or an exemption from immigration requirements. IRCC assesses factors such as establishment in Canada, family connections, the interests of affected children and the consequences of refusing the request. Approval is not guaranteed. (IRCC overview)
Inside Canada and overseas: different application routes
In Canada, a person may submit a stand-alone H&C permanent residence application or request an H&C exemption within a permanent residence application in a specific class. Overseas, there is no stand-alone H&C application: the written request must accompany a permanent resident visa application under an immigration class. Required fees and application requirements still matter. (IRCC application routes)
Pending refugee proceedings: a separate bar
Section 25(1.2) prevents examination while a refugee claim is pending before the Refugee Protection Division (RPD) or Refugee Appeal Division (RAD). It also covers someone whose refugee claim was ineligible for referral to the RPD and who has a pending protection application. The child and medical exceptions in subsection 25(1.21) apply specifically to the 12-month bar, not these pending-proceeding bars. (IRPA, section 25)
IRCC’s intake instructions also cover a claim determined eligible for referral to the RPD. Its table lists no exceptions for this pending-claim situation or the ineligible-claim/pending-PRRA situation. Do not assume a child’s presence permits a parallel H&C application. (IRCC restrictions)
The 12-month bar and its two exceptions
The statute separately restricts examination for 12 months after specified refugee decisions, including rejection, abandonment or withdrawal after substantive evidence was heard. Depending on the procedural history, the relevant date is the latest qualifying RPD, RAD or Federal Court refusal-of-leave or denial-of-review decision. (IRPA, paragraph 25(1.2)(c))

The statutory exceptions concern removal that would adversely affect a directly affected child’s best interests, or create a risk to life because adequate health or medical care cannot be provided in the relevant country or countries. Qualifying for an exception allows examination; it does not itself establish entitlement to permanent residence. (IRPA, subsection 25(1.21))
IRCC explains that a Federal Court review still pending more than 12 months after the RPD/RAD decision no longer keeps this bar running; a later refusal or denial restarts it. (IRCC timing explanation)
What evidence should applicants prepare?
IRCC’s application guide requires credible, objective evidence for a claimed exception. For children under 18, explain the direct adverse effects of removal. For the medical exception, support the life-threatening risk and the lack of adequate care. Applicants should identify the exemptions requested, substantiate their circumstances and keep IRCC informed of relevant changes. (Guide 5291)
A practical preparation approach is to organize your file into three parts:
- A procedural chronology: collect every claim, appeal and court decision, with dates and copies. Do not calculate eligibility from memory.
- A document-to-fact index: connect each important statement to evidence, rather than submitting an unexplained stack of records.
- A current circumstances summary: identify what has changed since previous submissions and which documents need updating.
Where children are affected, documents such as school information, care arrangements and relevant professional reports may help explain the actual impact. A medical case needs evidence tailored to the particular condition and treatment situation. These are preparation suggestions, not a universal checklist or a prediction of the result.
Other restrictions still need review
One pending H&C request prevents examination of another. Section 25 also excludes certain inadmissibility grounds, including sections 34, 35, 35.1 and 37. (IRPA, section 25) Designated foreign nationals face additional restrictions. A professional assessment should examine all potentially applicable bars, not just the 12-month rule. (IRCC restrictions overview)
Does filing H&C stop removal?
No. IRCC expressly states that an H&C application does not prevent or delay removal. The application can continue to be processed after departure. Anyone facing a removal date should obtain urgent case-specific advice rather than assume filing provides protection from enforcement. (IRCC removal-order guidance)
Before you decide what to file
Do not withdraw a refugee claim or abandon an appeal simply to pursue H&C based on a general article. First review the procedural consequences, available options, evidence and deadlines with an authorized professional.
