IRB Refugee Evidence Deadlines: November 2026 Changes Explained

Updated November 3, 2026. Preparing a refugee claim now requires close attention to more than the hearing date. The IRB’s updated procedural notice takes effect today. Start by locating your Confirmation of Referral and checking the date recorded there.
What are the new IRB refugee evidence deadlines?
The IRB’s official questions and answers sets out these personal-evidence deadlines:

Banks, insurance, real estate, tax & accounting, telecom, healthcare & education. Ask about relevant native in-article placements.
Contact Us →- Referral before November 3, 2026: 10 days before the hearing.
- Referral from November 3, 2026 to January 3, 2027, inclusive: 60 days after referral.
- Referral on or after January 4, 2027: 30 days after referral.
The practice notice makes the transitional 60-day extension automatic. No application is needed to use it. Personal evidence concerns your individual circumstances, such as identity papers, police records or supporting letters.
Country evidence and response evidence have different deadlines
Country-conditions documents remain due 10 days before the hearing. Documents responding to material supplied by another party or the RPD must arrive at least 5 days before the hearing, even where another deadline would otherwise apply. Personal documents in cessation or vacation applications are due at least 10 days before the hearing. See the IRB deadline guidance.

What happens when family claims are joined?
The IRB Q&A says that joining a claim to one referred before November 3 brings a 10-day-before-hearing deadline. For a claim joined to one referred on or after November 3, it states 30 days after your referral and says the RPD will send a deadline letter.
Check the letter carefully: the separate transitional notice grants 60 days for November 3–January 3 referrals. If the letter and transitional guidance seem inconsistent, promptly request clarification from the RPD or your counsel. Do not assume the later date applies.
If a document arrives after your deadline
The practice notice says to submit available documents on time rather than hold the entire package for a missing item. Later evidence requires prompt submission with a late-disclosure application explaining its relevance, why it is late and your efforts to obtain it. Acceptance is the member’s decision, not automatic.
Basis of Claim changes: watch the Notice to Appear
For pre-November 3 referrals, the transitional notice ties BOC amendments to receipt of the Notice to Appear: receipt through January 3, 2027 means the deadline is 10 days before the hearing; receipt from January 4 means 5 days after receipt. Use the required BOC-change form. Check the current rules and your notice for your own case.
These are separate from IRCC’s claim-completion deadlines
IRCC’s eligible-claim completion instructions give 60 days after receiving a Notice of Application Due Date. A one-time 30-day extension can be requested in the IRCC Portal before the original deadline. That process is distinct from the RPD’s evidence deadlines after referral.
Using one calendar entry labelled “refugee deadline” can create confusion. Record the issuing authority, document type, triggering event and delivery destination beside every due date.
A practical preparation checklist
- Keep the Confirmation of Referral, Notice to Appear and any RPD deadline letter together.
- Build separate folders for personal evidence, country research, BOC amendments and responses.
- Record when you requested each outstanding document and follow up early.
- Allow time for translation, review and submission checks.
- Ask for case-specific advice promptly when a deadline is unclear or already missed.
